The "GeoSnap.ai" Application is a digital platform aimed exclusively at brands and businesses, designed for analyzing and reconstructing a brand's positioning within its target market.
Through automated processes, the Application collects and processes publicly available information and outputs generated by artificial intelligence models to provide a concise description of the brand, its main thematic areas, territorial positioning (including geographical location and sub-location), and competitive context.
The Application also allows for the generation of buyer persona profiles and socio-demographic and behavioral characteristics potentially interested in the brand, as well as the creation of service descriptions, business proposals, and business model hypotheses.
This information constitutes hypothetical reconstructions and simulations, not related to real individuals, and is solely for informative, analytical, and strategic purposes. The Service is provided in both free and paid modes, according to the plans and features made available within the Application, and is intended to support the brand in understanding its positioning and possible areas of development, without guaranteeing economic or commercial results.
ART. 1 DEFINITIONS
For the purposes of these Terms and Conditions, the terms listed below will have the meanings specified here:
Provider:
Maind Group S.r.l., headquartered in Nembro (BG), Via Vincenzo Bellini 5, VAT 04822780161, the entity that develops, manages, and provides the Application.
Application / Web App:
The digital platform named "GeoSnap.ai", accessible online after registration and Account creation, intended exclusively for brands and businesses, enabling the analysis, reconstruction, and simulation of a brand's positioning in its reference market, through the processing of information and outputs generated by automated systems and artificial intelligence models, with both free and paid features.
Service:
The set of features made available through the Application that allow the Client to obtain brand analyses and reconstructions, including, but not limited to, brand description, identification of key thematic areas, geographic and territorial positioning, competitive context analysis, generation of buyer persona profiles, socio-demographic and behavioral characteristics potentially interested in the brand, and production of service descriptions, business proposals, and business model hypotheses. The Service is delivered through automated processes and outputs generated by artificial intelligence models with an informational, analytical, and strategic nature.
User / Client:
Exclusively the legal entity (brand/company) that registers and uses the Application, also through its delegates, for professional and commercial purposes.
Account:
The personal profile created within the Application, associated with access credentials and the User's data.
ART. 2 OBJECT OF THE CONTRACT
This contract governs the access and use of the "GeoSnap.ai" Application and regulates the contractual relationship between the Provider and the Client.
The Application allows the Client to benefit from a digital service aimed at the analysis, reconstruction, and simulation of a brand's positioning within its reference market.
In particular, the Service provides informative and strategic elaborations related, but not limited to, brand description, key thematic areas, geographic and territorial positioning, competitive context, and the creation of buyer persona profiles, socio-demographic and behavioral characteristics potentially interested in the brand, as well as the production of service descriptions, business proposals, and business model hypotheses.
The Client acknowledges and accepts that the Service is provided through automated processes and that the Analyses and Reports produced by the Application may include reconstructions, simulations, and hypotheses of a non-real nature, not related to existing physical persons, and do not constitute guaranteed data, projections, or objective assessments.
The Service is solely of an informative, analytical, and strategic nature and does not constitute personalized professional advice or guarantee economic, commercial, or reputational outcomes.
The access modalities to the Service, the available features, and any distinction between free and paid use are governed in subsequent articles and sections of the Application dedicated to the commercial offer.
ART. 3 SERVICE ACCESS MODALITIES
Access to the Application is granted exclusively after registration and Account creation by the Client, according to the methods indicated within the Application.
The Service is made available through the Application with different access modalities and levels of features, which may include free access and paid access.
The specific features, usage limits, available functionalities, and applicable economic conditions are indicated within the Application and may vary depending on the current commercial offer.
The Provider reserves the right to modify, expand, or reduce the access modes to the Service, available functionalities, and terms of use, while respecting any rights that may have already matured by the Client concerning activated paid services.
Access to the Service and the use of the functionalities of the Application is permitted exclusively for professional and commercial purposes, respecting these Terms and Conditions.
ART. 4 SERVICE OPERATION
The Application allows the Client to initiate analyses related to a selected brand, based on information provided by the Client and additional elements automatically processed by the system.
The Service operates through automated processes involving the collection, processing, and reprocessing of information related to the brand, to produce a concise representation of the brand's positioning in its reference context.
In particular, the Service allows:
to elaborate a description of the brand and its related activities;
to identify the main thematic areas (topics) associated with the brand;
to analyze the geographic and territorial positioning of the brand, including location and sub-location;
to reconstruct the competitive context of reference.
The Application also allows the generation of buyer persona profiles and socio-demographic, behavioral, and economic characteristics potentially interested in the brand, such as, for example, age, gender, lifestyle, spending capacity, and motivations of interest toward the brand.
These profiles are elaborated by the system in a simulated and hypothetical form and do not represent real physical persons nor data referable to identified or identifiable subjects.
Within the Service, the Application may also produce service descriptions, business proposals, offer hypotheses, and business model generation based on the elaborations made and intended to support the Client in evaluating their positioning and possible development strategies.
The Client acknowledges and accepts that all the Analyses, contents, and Reports generated by the Application are informational, analytical, and strategic elaborations based on simulations and hypotheses and do not constitute guaranteed data, predictions, personalized professional advice, or binding assessments.
ART. 5 SERVICE PLANS AND ANALYSIS MODES
The Service is provided through the Application according to different plans, distinguished by the breadth of analyses, the volume of elaborations, and the type of outputs generated.
Free Plan
The free plan allows the Client to obtain an initial analysis of the brand's visibility, based on the processing of a limited number of queries addressed to commonly used generative artificial intelligence models for information search (such as, for example, ChatGPT and Gemini).
Queries are formulated by the Application based on questions potentially relevant to the brand's sector and context.
Based on the responses generated by the artificial intelligence models, the Application elaborates and returns:
the frequency with which the brand is associated with the generated responses;
the possible mention of competitor brands as alternatives or replacements for the analyzed brand;
the information sources referenced or used by the artificial intelligence models in the responses, where identifiable;
The maximum number of elaborations and results returned within the free plan is limited and predetermined by the Application.
Paid Plan
The paid plan includes all the features of the free plan and provides access to more in-depth analyses, based on a significantly higher volume of queries and extended use of artificial intelligence models.
Within the paid plan, the Application also allows:
to analyze the overall sentiment associated with the brand, as deduced from the responses generated by the artificial intelligence models;
to identify the strengths and weaknesses of the brand based on the information and reviews known and referenced by the artificial intelligence models;
to obtain a more detailed comparative assessment compared to competitor brands;
Analyses are conducted solely based on the responses generated by the queried artificial intelligence models and do not provide for human verification or external validation of the contents.
Scope of Use and Data Access
The Client has access exclusively to analyses related to their brand. It is possible to consult analyses related to other brands or competitors through further Service activation.
The Application allows the Client to manage analyses related to the same brand in multiple territorial areas and countries, where provided by the available features.
Export and Sharing
The Analyses and Reports generated by the Application can be consulted within the Client's reserved area and, where provided, exported or downloaded in CSV and/or PDF formats, as well as shared through tools provided by the Application.
Nature of the Analyses
The Client acknowledges and accepts that all the Analyses, evaluations, and results produced by the Application represent a re-elaboration of the answers provided by the queried artificial intelligence models and aim to support the Client in understanding how the brand is represented and perceived in the responses generated by these models, without constituting guaranteed data, objective judgments, or accuracy assurances.
ART. 6 PAID SERVICES, DURATION, AND PAYMENT METHODS
The Application provides for the possibility of accessing paid services by subscribing to a quarterly plan.
The paid plan lasts three months and is activated through advance payment of the fee indicated within the Application at the time of purchase.
Advance payment is a necessary condition for accessing the services included in the plan.
By subscribing to the quarterly plan, the Client gains access to the advanced features of the Application, including complete brand analyses, based on a significantly higher volume of queries to artificial intelligence models compared to the free plan.
During the validity period of the quarterly plan, the Client is entitled to receive periodic updates of the analyses, on a monthly basis, as well as operational indications and concrete actions aimed at supporting the improvement of the brand's positioning in the responses generated by artificial intelligence models.
These actions may include, for example, strategic suggestions, content indications, and intervention proposals (such as, for example, drafting or optimizing informative content).
The paid plan does not provide for automatic renewal unless otherwise expressly communicated to the Client within the Application before the validity period expires.
ART. 7 RIGHT OF WITHDRAWAL
The Client has the right to withdraw from the contract within fourteen (14) days from its conclusion, without the need to provide any reason.
The right of withdrawal is excluded if the Client has requested the activation of the Service and has started using it before the withdrawal period expires.
In particular, the right of withdrawal is lost at the moment the Client accesses the Application and starts using the Service features, including, but not limited to, initiating analyses, consulting Reports, or accessing generated content.
Regarding paid services, the Client acknowledges and accepts that, following the activation of the Service and the start of its execution, it will not be possible to exercise the right of withdrawal or obtain a refund of the sums paid.
ART. 8 USE OF ARTIFICIAL INTELLIGENCE SYSTEMS AND SERVICE LIMITATIONS
The Client acknowledges and accepts that the Service is provided through the use of automated systems and third-party artificial intelligence models, used by the Application to formulate queries, process responses, and produce Analyses and Reports.
The Analyses and contents generated by the Application are based solely on the responses provided by the queried artificial intelligence models and on the re-elaborations performed by the system.
These responses may be variable, non-deterministic, and influenced by multiple factors, including, but not limited to, context, language, geographical area, updates to the models, and the sources known to the models at the time of the query.
The Client acknowledges that the Service does not involve human verification, editorial validation, or manual content control and that the Analyses are solely of an informative, analytical, and strategic nature.
The Provider does not guarantee the accuracy, completeness, updating, or reliability of the Analyses and Reports, nor that the information generated reflects the true or objective reputation, positioning, or perception of the brand.
The Client accepts that the use of the Service is aimed at understanding how the brand may emerge or be represented in the responses generated by artificial intelligence models and does not constitute an objective assessment, personalized professional advice, or guarantee of economic, commercial, or reputational results.
ART. 9 EXPORTATION, DOWNLOAD, AND SHARING OF REPORTS
The Analyses and Reports generated by the Application are made available to the Client within the reserved area and can, where provided by the Application functionalities, be exported or downloaded in digital format, including, but not limited to, CSV and PDF formats.
The Client may also share Analyses and Reports using the tools provided by the Application.
The Client acknowledges that sharing content involves the risk of unauthorized dissemination and assumes all responsibility regarding the use, communication, or disclosure of the Analyses and Reports to third parties.
Analyses and Reports may include references to competitor brands, informational sources, reviews, or other contents deducible from the responses generated by the artificial intelligence models.
The Client agrees to use these contents in compliance with applicable law and third-party rights, avoiding unlawful, misleading, or harmful use.
The Provider is not responsible for the use made by the Client or third parties of the exported, downloaded, or shared Analyses and Reports, nor for any consequences arising from their dissemination outside the Application.
ART. 10 LIMITATIONS OF LIABILITY
To the extent permitted by applicable law, the Provider is not liable for direct or indirect damages, financial or non-financial, loss of business opportunities, loss of profits, reputational damage, or consequences arising from the use of the Service by the Client.
The Provider is not responsible for the strategic, commercial, editorial, or operational decisions made by the Client based on the Analyses, Reports, or indications generated by the Application, which remain the full and autonomous responsibility of the Client.
The Provider does not guarantee that the Analyses and Reports generated will lead to improvements in brand positioning, an increase in visibility, sales, reputation, or that the identified competitor brands or emerged information are complete, correct, or up-to-date.
The Provider is not responsible for disruptions, errors, limitations, or changes in the third-party artificial intelligence models used by the Application, nor for their temporary or permanent unavailability.
The Provider bears no responsibility for the improper use of the Analyses and Reports by the Client or for their dissemination to third parties.
ART. 11 INTELLECTUAL PROPERTY AND USAGE RIGHTS
All intellectual and industrial property rights related to the Application, including, but not limited to, software, code, functionalities, system architecture, analysis methodologies, processing models, prompts, query flows, report structures, and any other technical or creative element constituting the Application, remain the exclusive property of the Provider or the respective rights holders.
The Analyses and Reports generated by the Application are licensed to the Client solely for non-exclusive, non-transferable, and time-limited use for the duration of the contractual relationship, for the Client's internal, strategic, and commercial purposes.
The Client is prohibited from reproducing, distributing, transferring, sublicensing, reselling, or using the Analyses and Reports as part of a service or product intended for third parties, without prior written authorization from the Provider.
It is understood that the Provider does not acquire any ownership rights over the trademarks, distinctive signs, or proprietary content of the Client that may be used within the Service.
ART. 12 SERVICE SUSPENSION AND TERMINATION
The Provider reserves the right to suspend or discontinue, wholly or partially, the provision of the Service, either temporarily or permanently, for technical, maintenance, security, legal compliance, Application updates, or force majeure reasons.
The Provider may also suspend or limit the Client's access to the Application in the event of Service use in violation of these Terms and Conditions, applicable laws, or the Service's intended purposes.
Suspension or termination of the Service, in the cases indicated above, does not entitle the Client to any indemnities, compensations, or refunds, except as expressly provided by law.
It is understood that the Provider may definitively cease the provision of the Service, providing prior notice to the Client, where possible, through the Application or other appropriate means.
ART. 13 AMENDMENTS TO TERMS AND CONDITIONS
The Provider reserves the right to amend these Terms and Conditions at any time.
Changes will be communicated to Users via the Application or other appropriate means.
Use of the Application after the publication of amendments implies acceptance of the same.
ART. 14 PERSONAL DATA PROCESSING
The processing of personal data of the Client and any persons operating on their behalf is carried out in compliance with Regulation (EU) 2016/679 (GDPR), Italian Legislative Decree 196/2003 as amended by Legislative Decree 101/2018, and applicable personal data protection regulations.
The Data Controller is the Provider, whose identification details are indicated in the Privacy Notice available within the Application and consultable before registration and at any subsequent time.
Personal data processed in the context of the Application usage may include, but is not limited to, the Client's identification and contact data, access and use data of the Application, as well as data relating to the analysis requests made.
The processing is carried out exclusively for purposes related to the provision of the Service, management of the contractual relationship, fulfillment of legal obligations, and, where applicable, for statistical purposes and Service improvement, including through aggregated or anonymized data.
The Client acknowledges and accepts that the Analyses and Reports generated by the Application do not include personal data of real individuals and that any references to profiles, socio-demographic or behavioral characteristics constitute simulated elaborations not linked to identified or identifiable subjects.
The methods, legal bases, data retention times, and data subject rights are detailed in the Privacy Notice, which forms an integral part of these Terms and Conditions.
ART. 15 GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by Italian law.
For any disputes related to the validity, interpretation, execution, or termination of these Terms and Conditions, the Court where the Provider's headquarters is located shall have jurisdiction.
ART. 16 COMMUNICATIONS

ART. 17 ACCEPTANCE OF TERMS AND CONDITIONS
The User declares to have read carefully, understood, and fully accepted these Terms and Conditions.
Acceptance is made by selecting the appropriate confirmation box (so-called point of click) present on the Application at the time of registration and constitutes, in all respects, the subscription of this contract.
Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, with the same point of click, the User also declares to have read, understood, and expressly accepted the vexatious clauses contained in the following articles: ART. 7 (Right of Withdrawal), ART. 8 (Use of Artificial Intelligence Systems and Service Limitations), ART. 10 (Limitations of Liability), ART. 11 (Intellectual Property and Usage Rights), ART. 12 (Service Suspension and Termination).
